2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 191(2), 190, 126(2), 121(1), 121(2), 132 and 109 of BNS.
3. The case of the prosecution, in short, is that on secret information of illegal mining of sand from river Niranjana, the informant reached at village Laddu and he saw 810 tractors with trailer were loading sand illegally by the labourers. Thereafter the informant tried to catch the accused persons but they fled way. The informant seized a tractor and he was bringing the said tractor to the police station. In the meantime, petitioner along with other accused persons armed
Patna High Court CR. MISC. No.83809 of 2025(2) dt.05-02-2026 2/3 with lathi, danda and brick-stones attacked on the informant and his police party due to which they received injuries.
4. Learned counsel for the petitioner has submitted that the name of this petitioner along with others has been disclosed by the local chowkidaar. Learned counsel for the petitioner has further submitted that the nature of allegation is general and omnibus and there is no specific allegation against the petitioner. From perusal of the injury report it is also clear that the injuries received by the informant were found to be simple in nature caused by hard and blunt object. It has further been submitted that similarly situated co-accused Rahul Singh has been granted bail by the learned Co-ordinate Bench vide Cr. Misc. No. 63037 of 2025. The case of this petitioner stands on similar footing. Learned counsel for the petitioner has lastly submitted that the petitioner is having no criminal antecedent and is in judicial custody since 21.09.2025.
5. Learned Additional Prosecutor for the State has vehemently opposed the bail application of the petitioner.
6. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Mohanpur P.S. Case No. 221 of 2025 on
Patna High Court CR. MISC. No.83809 of 2025(2) dt.05-02-2026 3/3 furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-II, Sherghati, Gayaji.
