2. Petitioner apprehends arrest in a case registered for the offence punishable under section 317 (5) of BNS 2023 and Section 30(a) of Bihar Prohibition and Excise (Amendment ) Act 2022 .

3 . As per prosecution case , 156.00 liters of country made liquor was recovered from the seized vehicle .

4. It is submitted that the petitioner is innocent and has falsely been implicated in this case only on the basis of suspicion . No incriminating material has been recovered from the conscious possession of the petitioner.

5. Learned counsel for the State submits that petitioner has got 5 criminal antecedents out of which 4 are of

Patna High Court CR. MISC. No.87913 of 2024(3) dt.05-02-2025 2/2 similar nature .

6. Considering the fact that petitioner has got 4 criminal antecedents of similar nature , prayer for anticipatory bail is rejected.
