====================================================== CORAM: HONOURABLE JUSTICE SMT. SONI SHRIVASTAVA ORAL ORDER 16-07-2025 Heard learned counsel for the petitioner, learned APP for the State and learned counsel for the complainant.

2. The petitioner apprehends his arrest in a case registered for the offences punishable under Section 498(A) of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act and he is husband of the complainant.

The matter had been sent to the Patna High Court Mediation Centre for amicable settlement of disputes between the parties and both of them have resolved their issues vide Memorandum of Agreement dated 30.06.2025 passed in Mediation Proceeding No. 678 of 2025 whereby the parties have agreed to live separately and the petitioner has offered an

Patna High Court CR. MISC. No.88193 of 2024(4) dt.16-07-2025 2/3 amount of Rs. 10 lacs as full and final settlement of the disputes between the parties. Out of the said amount, the first installment of Rs. 5 lacs vide cheque no. 648114 in the name of the complainant would be handed over to her on 12.08.2025. However, the second installment of another Rs. 5 lacs would be paid as per schedule on 11.11.2025 and it is expected that by that time, the application under Section 13 (B) of the Hindu Marriage Act would be filed and the cases against each other would be withdrawn.

4. Learned counsel appearing for the complainant also supports the memorandum of agreement.

5. In such view of the matter, let the petitioner, above named, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned lower Court where the case is pending/successor Court in connection with Complaint P.S. Case No. 3355 of 2023, subject to the condition as laid down under Section 438 (2) of the Cr.P.C/ 482 (2) of the BNSS, 2023.

6. However, it is made clear that the bail bond of the petitioner shall be accepted by the learned Court below on
