2. The petitioner seeks bail in connection with Baghaila P.S. Case No. 05 of 2023 registered for the offence under Section 341, 323, 304(b), 504, 506/34 of the Indian Penal Code.

3. As per the prosecution case, the petitioner is accused of killing his wife.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case and he is in jail since 14.08.2023 along with his minor child aged about three years. He further submits that the deceased died during the course of treatment.

5. Learned APP for the State vehemently opposed the

Patna High Court CR. MISC. No.1558 of 2024(2) dt.18-01-2024 2/2 prayer of the petitioner for grant of bail.

6. Considering the aforesaid facts, the period of custody and also considering the fact that the petitioner is in jail with his minor child, this application is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Judge-IV-cum-ACJM, Sasaram, Rohtas in connection with Baghaila P.S.
