The petitioner seeks bail in connection with Ghorasahan P.S. Case No. 351 of 2023 instituted for the offence under Section 392 of the Indian Penal Code.

As per prosecution case, it is alleged that three unknown miscreants assaulted the informant at his shop and looted cash to the tune of Rs. 40,000/-, mobile phones, CCTV Camera, Biometric Machine, WIFI and a bag containing Aadhaar Card, Pan Card, Voter ID Card etc. and fled away on motorcycle.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 21-08-2023. Petitioner

Patna High Court CR. MISC. No.24 of 2024(2) dt.19-01-2024 2/2 bear one criminal antecedents, as per disclosure made in paragraph No. 3 of the bail application.

It has been further submitted by the petitioner's counsel that petitioner has been falsely implicated in the present case. Name of the petitioner has been surfaced in this case due to confessional statement of co-accused, namely, Chandra Bhan Singh. No T.I. Parade has been conducted in this case and there is no recovering of any incriminating articles from the possession of the petitioner.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. 7.

Considering the aforesaid facts and circumstances of the case, period of custody of the petitioner, this Court is inclined to grant bail to the petitioner.

Let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Ghorasahan P.S. Case No. 351 of 2023.
