JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER (Per: HONOURABLE THE CHIEF JUSTICE) 20-01-2020 This Letters Patent Appeal has been preferred for setting aside the judgment and order dated 26.3.2018 passed by the learned Single Judge in C.W.J.C. No. 14497 of 2016. It is not disputed before us that the petitioner has got no right, title or interest in the land in his possession. Undoubtedly and undisputedly, the land in question is a public land. Only for the reason that the petitioner has been occupying the same along with others would not confer any right, title or interest upon him and as such he has to be evicted
Patna High Court L.P.A No.1558 of 2018(3) dt.20-01-2020 2/2 by virtue of the provision of Bihar Public Land Encroachment Act, 1956.
Before us, the petitioner has not placed any material to show that he is entitled to any benefit under any policy framed by the Government, entitling the encroacher to be rehabilitated or accommodated on the land in question. Accordingly, the present petition is devoid of merit and the same is dismissed.
