The petitioner seeks bail in connection with Case No. G.O. Case No.138 of 2019 registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that there is recovery of 88.500 liters of Nepali Saufi wine from the motorcycle of the petitioner and he further submits that the petitioner has got no criminal antecedent. Petitioner is in jail custody since 24.10.2019.

In the facts and circumstances of the case, I am

Patna High Court CR. MISC. No.77731 of 2019(2) dt.29-11-2019 2/2 inclined to grant bail to the petitioner, subject to deposit of Rs.10,000/- in the court below/Nazarat. Let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional District and Sessions Judge-II-cum-Special Excise Act, Sitamarhi in connection with G.O. Case No. 138 of 2019.

Such deposit of Rs.10,000/- shall abide by the outcome of the criminal case.
