JUSTICE DINESH KUMAR SINGH ORAL ORDER 08-02-2019 The present application has been preferred by the petitioners with a prayer for anticipatory bail in a case registered for the offences punishable under Sections 406, 420 and 120B of the Indian Penal Code.

Though, it appears that on the joint prayer of the parties this matter was referred to the Mediation and Conciliation Centre of the Bihar State Legal Services Authority vide order dated 14.12.2018, but the report of the Mediator dated 06.02.2019 at Flag 'A' reflects that the issue could not be resolved through the process of mediation.

However, learned counsel for the petitioners seeks permission to withdraw this application, in view of the fact that

Patna High Court Cr.Misc. No.67856 of 2018(3) dt.08-02-2019 2/2 the further proceeding of Paltiputra P.S. Case No. 253 of 2018 has been stayed vide order dated 06.02.2019 passed in Cr. Misc. No. 329 of 2019, with liberty to file fresh application for grant of anticipatory bail if the occasion arises.

Permission is accorded.

Accordingly, this application is dismissed as withdrawn with the liberty aforesaid.
