The petitioners have filed the instant application for grant of regular bail in a case registered for the offences punishable under Sections 394 of the Indian Penal Code.

The prosecution case in nutshell is that while the informant along with Mahesh Ram on Motorcycle, they were intercepted by three miscreants. It is further alleged that they assaulted the informant by means of butt of pistol and snatched his motorcycle.

No.86394 of 2023(2) dt.11-01-2024 2/3 It is submitted by learned counsel for the petitioners that the petitioners are innocent and he has falsely been implicated in the present case. Neither the petitioners are named in F.I.R. nor they have been put on T.I.P. Nothing incriminating has been recovered from their possession. The name of petitioners sprang up in this case on the basis of their self confessional statement in other case and they were remanded in the present case. Moreover, they are languishing in judicial custody since 27.07.2023.

Learned APP appearing for the State has vehemently opposed the prayer for Bail.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case as well as period of custody, this Court is inclined to enlarge the petitioner on bail. The above named petitioners is directed to be enlarged on bail in connection with Rasulpur P.S. Case No. 131 of 2022 on furnishing bail bond of Rs. 10,000/- (Rupees
