2. The petitioner is in custody since 05/08/2023 in connection with K. Hat P.S. Case No. 919 of 2023 registered for the offence punishable under Sections 8(c)/21(b) of NDPS Act.

3. As per the prosecution case, 37 grams of Smack and Rs. 7040/- have been recovered from the possession of the petitioner.

4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case. He further submits that nothing incriminating has been recovered from the possession of the petitioner.

5. Learned Additional Public Prosecutor appearing on behalf of the State has vehemently opposed the prayer for bail.

7. Considering the criminal antecedents of the petitioner, I am not inclined to grant bail to this petitioner though the co-accused has been granted bail by a co-ordinate Bench of this Court. It is, accordingly, rejected.

8. The trial Court is directed to expedite the trial.

9. The petitioner may renew his prayer for bail if trial is delayed because of prosecution.
