Petitioner seeks bail in Excise Case No.333 of 2019 registered under Section 30(a) of the Bihar Prohibition and Excise Act.
The excise official intercepted a container and recovered 3952 litres of Indian made foreign liquor. Learned counsel for the petitioner submits that the petitioner is the temporary driver of the container. The container was sealed. The owner of the container asked the petitioner to drive the container informing him that inside the container, there are motor parts. The petitioner had no knowledge about the liquor kept inside the container, which was sealed. The petitioner has remained in custody for about six months for no

Having considered the facts and the nature of allegation made against the petitioner and the fact that the petitioner is the temporary driver of the container, who is in custody for about six months, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/-(rupees ten thousand) with two sureties of like amount each to the satisfaction of learned A.D.J. 2-cum-Special Judge, Excise Act, Gopalganj in connection with Excise Case No.333 of 2019, subject to the condition that one of the bailors shall be the local having substantial immovable property.
