Heard learned counsel for the petitioner and learned counsel for the respondents.
Petitioner has prayed for the following reliefs: "(i) For a direction upon the Respondents to establish peaceful atmosphere in the Anugrah Narayan Medical College and Hospital so that the
Patna High Court CWJC No.21684 of 2018(2) dt.06-01-2020 2/3 Patient visiting this premier hospital may get adequate medical facilities.
(ii) For a direction upon the Respondents to make the said hospital free from disturbances being caused by the Class-3 and Class-4 employee on regular basis who have not been transferred in last 5 to 25 years and by their long stay at one place they have developed local influence/intimacy and by using their local influence and force against the management they are jeopardizing the objective of this premier medical college, most of them are running parallel medical services on commercial basis, with a view to promote their proxy clinics/health centre they have been creating problems and discouraging the development of the said medical college.
(iii) For a direction upon the Respondents not to give the benefit of the policy of the government concerning transfer of office bearers of the Union whereby they are not to be transferred from one place to another and further to transfer all those employees of the Hospital who have not been transferred in last 5 to 25 years of service in the light of guidelines given by Hon'ble Lokayukt in Case No. 1/lok(health)22/2011 Mrs. Meena Devi vs. Nageshwar Mandal."
After the matter was heard for some time, learned counsel for the petitioner submits that petitioner shall be content if a direction is issued to the concerned respondents to consider and decide the representation, which the petitioner shall be
Patna High Court CWJC No.21684 of 2018(2) dt.06-01-2020 3/3 making afresh within a period of four weeks from today. Learned counsel for the State states that upon receipt of such request, if any, the same shall be dealt with in accordance with law, expeditiously and positively within a period of three months from the date of receipt thereof. Equally, liberty is reserved to the petitioner to take recourse to such alternative remedies as are otherwise available in accordance with law.
We are hopeful that as and when petitioner takes recourse to such remedies, as are otherwise available in law, before the appropriate forum, the same shall be dealt with, in accordance with law and with reasonable dispatch.
