JUSTICE ASHUTOSH KUMAR ORAL ORDER 19-03-2020 The petitioner, who is in custody since 18.09.2019, seeks bail in connection with Excise Case No. 332 of 2019, District Gopalganj, instituted for the offence under Section 30 (a) of the Bihar Excise Act, 2018.

The petitioner is the driver of the container which was intercepted and from where recovery of liquor was made.

Learned counsel for the petitioner has submitted that the petitioner was made to understand that he was required to deliver black slate stone which was loaded at Rajasthan to some place in Siliguri. The petitioner had no idea that along with black slate stone,

The petitioner has clean antecedents.

Regard being had to the aforestated facts, the petitioner is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J. 2 cum-Special Judge, Excise Act, Gopalganj in connection with Excise Case No. 332 of 2019.

The application stands allowed.
