JUSTICE MOHIT KUMAR SHAH ORAL ORDER 28-07-2022 The present writ petition has been filed for removal of encroachment made by the encroachers over the public land situated at Plot nos. 1733, 2020, 2019 and 2065, Khata no. 359 in village-Bharub, Tola- Ganga Bigha, PS-Obra, DistAurangabad. At the outset, the learned counsel for the petitioner seeks liberty to approach the Circle Officer, Daudnagar i.e. the

Patna High Court CWJC No.94 of 2019(3) dt.28-07-2022 2/2 respondent no. 4.

Liberty so sought, is granted.

It is needless to state that in case, the petitioner approaches the respondent no. 4 by filing appropriate petition under the provisions of the Bihar Public Land Encroachment Act, 1956, within a period of four weeks from today, the Circle Officer, Daudnagar, Aurangabad shall consider the same and after hearing the affected parties, shall pass final order under Section 6(1) of Bihar Public Land Encroachment Act, 1956, within a period of twelve weeks, thereafter.

The writ petition stands disposed off on the aforesaid terms.
