Learned counsel for the petitioner submits that only because there being a Biometrical error in thumb impression, during the course of recording her appearance in the process of counselling by this petitioner, the authorities did not allow this petitioner to appear for counselling, though the petitioner has already cleared the Competency Test for Local Bodies Teachers (CTT), 2024.

3. It is a very sorry state of affair that only because of system employed for recording attendance of a candidate, which showed some error for reasons beyond control of the candidate, the rights of the candidates should not have been prejudiced in such manner.

On the other hand, learned counsel for the State on being confronted with respect to the manner in which, the candidature of this petitioner has been rejected, the learned counsel submits that the reasons for non-consideration may not be accepted in law and, therefore, appropriate directions may be issued to the District Education Officer, Buxar for allowing this petitioner to appear in the counselling, which might be scheduled in near future or through special process of counselling.

Considering the stand of the State and keeping in mind the fact the petitioner has cleared the Competency Test for Local Bodies Teachers (C.T.T.), 2024 and her candidature should not have been prejudiced in the manner as has been done, this Court finds it proper to direct the District Education Officer, Buxar to address the issues seriously and as and when, the fresh counselling process is undertaken by the District officials, the petitioner's case would be considered on priority

Patna High Court CWJC No.20264 of 2025(2) dt.16-12-2025 3/3 basis and if she is found fit, then the consequential benefits shall also be extended in her favour forthwith.

6. Accordingly, the instant writ petition stands disposed of.
