====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 10-12-2018 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in Guraru P.S. Case No. 180 of 2018 instituted for the offence under Section 30(a) of Bihar Wine Prohibition and Excise Act.

It is alleged in the written report that total 150 liters Mahua liquor has been recovered from four wheeler kept in 30 bags. Teju Kumar and Pappu Kumar were apprehended by the police with aforesaid four wheeler. The apprehended persons disclosed before the police that said liquor belongs to the petitioner.

Counsel for the petitioner submits that petitioner is in custody since 20.9.2018. Counsel for the petitioner further submits that co-accused Teju Kumar and Pappu Kumar have

Patna High Court Cr.Misc. No.70959 of 2018(2) dt.10-12-2018 2/2 already been granted bail by coordinate Bench of this Court vide order dated 28.11.2018 passed in Cr. Misc. 28.11.2018. Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Excise Judge, Gaya, in connection with Guraru P.S. Case No. 180 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
