JUSTICE SHAILENDRA SINGH ORAL ORDER 11-12-2025 The instant writ petition has been filed by the petitioner under Article 226 of the Constitution of India, seeking the following relief(s):- " (i.) For a direction to the respondent number 4 to 7 to settle the land for home according to the circular of Bihar Government. The petitioner is belong to SC/ST and landless. She is residing on government land having made a home from 48 year bearing khata number 110 plot number 1033 area .4 dismal Thana number 707 Anchal Rafiganj district Aurangabad Bihar and after then she has taken a electric line from electric department government of Bihar and she deposited the electric bill to the government.

2. Mr. Surendra Prasad Singh, learned counsel for the petitioner and Mr. Kamlesh Kishore, learned AC to SC-12 appearing for the State-respondents are present.

3. It is submitted by the petitioner's counsel that the petitioner belongs to the SC/ST community and is a landless lady. She has been residing on Government land for the last forty-eight years, and the land measuring four decimals pertains to Khata No. 110, Plot No. 1033, Thana No. 707, situated at Anchal- Rafiganj in Aurangabad District. The petitioner has also taken an electricity connection from the Government of Bihar and has been continuously depositing the electricity bill to the State of Bihar.

The petitioner has filed an application before the District Magistrate, Aurangabad, for the allotment of the said land under the scheme of the Government of Bihar launched in connection with landless persons vide Letter No. 4 Kha-MaNiti-101/712/2188/Ra dated 12.05.1971, and the same is still pending.

5. This Court is of the view that the issue raised by the petitioner is premature for consideration before this Court.

Patna High Court CWJC No.20009 of 2025(2) dt.11-12-2025 3/3 However, the District Magistrate, Aurangabad, Respondent No. 4, before whom the petitioner's application (Annexure-P/5) is pending, is directed to dispose of the same as per the provisions of law within three months from the date of receipt or production of a copy of this order.

6. Accordingly, the instant writ petition stands disposed of.
