Earlier the prayer for bail of the petitioner was rejected , vide order dated 22.5.2019 passed in Cr. Misc. No.24423 of 2019 with condition that if the trial is not concluded within a period of six months, the petitioner is at liberty to renew his prayer for bail.

Submission of the learned counsel for the petitioner is that though the charge has been framed and not a single witness has been examined and the petitioner is in custody since 11.2.2019.

In view of the submissions as made above, this application is disposed of with direction to the learned trial court to verify the above submission and if it is found true, petitioner

Patna High Court CR. MISC. No.79632 of 2019(2) dt.05-02-2020 2/2 shall be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Second Addl. District and Sessions Judge cum Special Judge, Excise, Rohtas, Sasaram in connection with Nokha P.S.Case No.203 of 2018 with condition that he has to co-operate in the disposal of the trial.
