1. Heard the parties.
2. The petitioner apprehends his arrest in connection with Singheshwar P.S. Case No. 359 of 2024 dated 10.09.2024 registered under Section 30 (a) of the Bihar Prohibition and Excise Amendment Act, 2022.
3. As per the F.I.R. Police intercepted two vehicles and upon seeing the Police party four persons started fleeing away and succeeded in the same. Police arrested two persons who disclosed the name of the petitioner and others who succeeded in fleeing away. 264.120 liters of illicit liquor has been recovered from both the vehicles.
4. Learned counsel for the petitioner submits that the

No.87733 of 2024(2) dt.21-01-2025 2/3 petitioner is having no criminal antecedent and he has been made accused on the basis of disclosure of his name by the arrested co-accused. Two vehicles from where illicit liquor has been recovered do not belong to the petitioner as stated in paragraph no. 10 of the present bail application. He further submits that similarly situated co-accused Rahul Kumar has been granted anticipatory bail by this Court in Cr. Misc. No. 79115 of 2024.

Regard being had to the submission made by the parties, taking into consideration the fact that the illicit liquor has not been recovered from the conscious possession and / or vehicle belonging to the petitioner, the petitioner is having no criminal antecedent and similarly situated co-accused has been granted anticipatory bail by this Court, I am inclined to grant anticipatory bail to the petitioner.
6. Let the petitioner, above named, be released on anticipatory bail in the event of arrest or surrender before the court below within a period of four weeks from today on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of Additional Sessions Judge Vth cum Special Judge Excise 1 Madhepura in connection with Singheshwar P.S. Case No. 359
