On the first date of hearing on 12.12.2019 there was no representation and as such the matter was adjourned by the coordinate bench.
On 18.05.2023 another coordinate bench took up the matter where again there was no representation. Today on call the case remains unrepresented. The prayer is for quashing the requisition dated Nil which was received in the office of Respondent no.5 on 03.10.2019 on the ground that:
(a) The said requisition is under the teeth of the
Patna High Court CWJC No.24958 of 2019(4) dt.21-06-2023 2/2 exception carved out by the Amendment Act of 2015 with effect from 01.01.2016, according to which such a No Confidence Motion may be brought only once in the whole tenure of Pramukh;
(b) The requisition was further bad in law for noncompliance of mandatory provision as contained under SubSections3(i) of Section -44 of the Bihar Panchayat Raj Act, 2006.
It seems the petitioner only for the sake of filing writ petition has preferred the same and never intended to contest the same.
The petition accordingly stands dismissed.
