The petitioner, who is in custody since 07.09.2019 seeks bail in connection with Saraiya P.S. Case No. 401 of 2019 which has been instituted for the offences under Sections 272, 273, 353, 120(B) of the Indian Penal Code and Section 30(a), 45 of the Bihar Prohibition & Excise Act, 2016.

It appears that a tank-lorry dashed against the house of a co-villager and when the driver was asked to give compensation, he ran away. On this information, the police arrived at the place of occurrence and learnt that the tank-lorry containing liquor was brought in the village by one Sobhit Paswan who intended to sell the

Later, the petitioner and others are said to have taken away the liquor bottles stored in the tank-lorry despite the police party stopping them. The petitioner and others are also said to have indulged in scuffle with the local police.

It has been averred in the bail petition that the name of the petitioner has been provided to the police party by the local villagers who have definite axe to grind against him.

Considering the clean antecedents of the petitioner and the period of custody, he is directed to be released on bail on his furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act, Muzaffarpur in connection with Saraiya P.S. Case No. 401 of 2019.
