2. The petitioner has preferred this application for grant of regular bail in connection with Marhowrah P.S. Case No. 746 of 2023 dated 03.12.2023 registered for the offences punishable u/ss 147, 148, 149, 341, 323, 325, 332, 333, 307, 353 of the IPC and section 30(a) of the Bihar Prohibition and Excise Act.
3. As per the prosecution case, the police official conducted a raid and recovered total 75 litres of illicit country made liquor from the bush near the canal. It is further alleged that 50 miscreants along with the petitioner armed with various weapons came there and attacked the police official and made

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner has no concern with the alleged recovery rather the recovery was made from an open place that is accessible to anyone. Nothing has been recovered from the conscious possession of the petitioner. The petitioner has seven criminal antecedents as stated in para 3 of the bail petition. The petitioner is in custody since 11.11.2025. The co-accused person has already been granted regular bail by this Court vide order dated 17.10.2025 passed in Cr. Misc. No. 69196 of 2025.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Saran at Chapra in connection with Marhowrah P.S. Case No. 746 of 2023, with a condition:- (i) The petitioner is directed to remain physically present before the learned Court below on each and every date,
Patna High Court CR. MISC. No.85389 of 2025(2) dt.08-12-2025 3/3 failing which on two consecutive dates without reasonable cause, the bail bonds of the petitioner are liable to be cancelled.
7. The application stands allowed.
