2. The petitioner seeks regular bail in connection with Muffasil Singhaul P.S. Case No. 534 of 2023 registered on 14.09.2023 lodged under Sections 08/20(B)(ii)(B), of the N.D.P.S. Act and 29 Narcotic Act and Section 25(1-b)a/26 Amrs Act.
3. As per the prosecution case, F.I.R. has been lodged against petitioners and four others.
4. Counsel further submits that petitioner is innocent and has committed no offence. He further submits that from the content of the F.I.R., it is very much clear that from the place of occurrence only two accused persons were apprehended other than petitioner from whose possession N.D.P.S., material has been recovered and Arms were recovered.
5. Counsel for the petitioner submits that name of the
Patna High Court CR. MISC. No.1033 of 2024(2) dt.18-01-2024 2/3 petitioner has been figured in this case by the virtue of confessional statement of the co-accused who has disclosed that he has purchased Ganja from the petitioner and it is due to this reason petitioner has been made accused in this case.
6. Counsel for the petitioner further submits that the co-accused on whose disclosure petitioner has been figured in this case has been granted bail by co-ordinate Bench of this Court vide order dated 19.01.2024 in Cr. Misc. No. 680/2024.
7. Counsel further submits that there is one criminal antecedent in which he is on bail and petitioner is in custody since 29.09.2023.
8. Learned counsel for the State opposes the prayer for bail.

In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Session Judge-I Begusarai in connection with Muffasil Singhaul P.S. Case No. 534 of 2023, subject to the following conditions as well as the conditions laid down under Section 437 (3) of the
Patna High Court CR. MISC. No.1033 of 2024(2) dt.18-01-2024 3/3 Cr.P.C.
(i) one of the bailor should be the family member of the petitioner who shall provide official document to show his bona fide;
(ii) the petitioner shall appear on each and every date before the Trial Court and failure to do so for two consecutive dates without plausible reason will entail cancellation of his bail bonds by the Trial Court itself;
(iii) the petitioner shall appear before the concerned police station every month for one year to mark attendance; (iv) the petitioner shall in no way try to induce or promise or threat the witnesses or tamper with the evidence, failing which the State shall be at liberty to take steps for cancellation of the bail bonds; and (v) the petitioner shall desist from committing any criminal offence again, failing which the State shall be at liberty to take steps for cancellation of the bail bonds.
