This application for anticipatory bail arises out of Rajpur P.S. Case No. 104 of 2018, disclosing offences under Sections 366A and 376 of the Indian Penal Code. From the perusal of the statement of the victim under section 164 Cr. P.C., it is easily noticeable that the main allegation is against the co-accused Sunil Sah. So far as this petitioner is concerned, the only allegation is that he was instrumental in taking the informant to Secunderabad, where the informant is said to have stayed with him for some time and later came in contact with the accused Sunil Sah with whom she got married. It is alleged that Sunil Sah harassed her and sexually abused. The said Sunil Sah has been granted regular

Patna High Court Cr.Misc. No.69569 of 2018(2) dt.17-12-2018 2/2 bail by this Court by order dated 09.10.2018, passed in Cr. Misc. No. 59208 of 2018.

Considering the statement of the victim girl under Section 164 Cr.P.C., this application is allowed. Let the petitioner above named, in the event of his arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District Judge-1st cum-Special Judge POCSO Act, Buxar in Rajpur P.S. Case No. 104 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bond shall be liable to be cancelled.
