JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 13-12-2018 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Jagdishpur P.S. Case No. 125 of 2016 registered for the offence punishable under Section 394 of the Indian Penal Code. Although, petitioner is not named in the first information report but in course of investigation, the name of petitioner came in confessional statement of co-accused. It is a serious case of Section 394 of the I.P.C. and, therefore, considering the aforesaid facts and circumstances as well as submissions of the parties, I am not inclined to extend the privilege of anticipatory bail to petitioner and accordingly, his prayer for anticipatory bail stands rejected.
