The petitioner is seeking anticipatory bail in connection with Mansi P.S. Case No. 153 of 2018 registered under Sections 307, 504/34 of the Indian Penal Code and 27 of the Arms Act.

Learned counsel for the petitioner submits that even though there is allegation of firing against accused persons including the petitioner, the fact remains that no evidence of firing could be found in course of investigation. It is submitted that no injury whatsoever has been caused in the alleged occurrence. It is further submitted that in the impugned order even learned Sessions Judge, Khagaria has noted that it is a case of no injury. It is submitted that there is no criminal antecedent

Patna High Court Cr.Misc. No.75252 of 2018(2) dt.21-12-2018 2/2 against the petitioner.

Learned counsel for the State is present and opposes the prayer for anticipatory bail of the petitioner. In the given facts and circumstances of the case, in the event of his arrest/surrender before the court below within a period of four weeks, let the above-named petitioner be enlarged on bail furnishing bail bond of Rs. 15,000/- (Rupees Fifteen Thousand only) with two sureties of the like amount each to the satisfaction of learned C.J.M., Khagaria, in connection with Mansi P.S. Case No. 153 of 2018, subject to condition that petitioner shall join investigation by reporting to the Investigating Officer within a period of three weeks from today and shall cooperate in course of investigation, failing which the Investigating Officer shall be at liberty to take steps for cancellation of bail. This will be in addition to condition prescribed under Section 438(2) of the Code of Criminal Procedure.
