====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 02-12-2025 Heard learned counsel for the petitioners and learned A.P.P. for the State.

2. Petitioners seek regular bail in connection with Masaurhi P. S. Case No. 285 of 2025 in a case registered for the offences punishable under Sections 103(1), 61(2), 238 of the Bharatiya Nyaya Sanhita.

3. As per prosecution case, informant suspects that all the F.I.R. named accused persons, including these petitioners, committed murder of the son of informant since they were not happy with inter-caste love marriage of the son of informant with one Muskan Kumari.

4. Learned counsel for the petitioners submits that petitioners are innocent and have committed no offence. Informant is not an eye witness of the occurrence and only suspicion has been raised against these petitioners as petitioner no. 1 is Mausa and petitioner nos. 2 & 3 are co-villagers of the wife of deceased. Charge-sheet has already been submitted. Petitioners claim clean antecedent and are in custody since 25.06.2025.

5. Learned A.P.P. for the State vehemently opposed the bail application.

6. Considering the nature of allegation, clean antecedent and period of custody, the bail application is allowed. Let the above named petitioners be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of SubDivisional Judicial Magistrate, Masaurhi in connection with Masaurhi P. S. Case No. 285 of 2025 (Prabhat Kumar Singh, J) Navya/- U T
