JUSTICE ASHUTOSH KUMAR ORAL ORDER 16-03-2020 The petitioner, who is in custody since 15.06.2019, seeks bail in connection with Amnour P.S. Case No. 112 of 2019 dated 07.05.2019 instituted for the offence under Section 392 of the Indian Penal Code. The petitioner has neither been named in the FIR nor anything incriminating has been recovered from his possession. Despite being in custody for such a long time, he has also not been put on test identification parade.

The petitioner has been made accused in five other cases, out of which, two cases are of the year 2016-17 and in those cases, the petitioner has been granted bail. In the present times, the petitioner was arrested in Chapra Muffasil P.S. Case No. 130 of 2019 and he has been remanded in two other cases thereafter

Patna High Court CR. MISC. No.78680 of 2019(3) dt.16-03-2020 2/2 apart from the present case. The list of cases in which the petitioner has been made accused has been noted in paragraph -3 of the petition.

Regard being had to the nature of accusation against the petitioner and his period of custody, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate II, Saran at Chapra in connection with Amnour P.S. Case No. 112 of 2019.
