====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 31-01-2024 Heard Mr. Yugal Kishore, learned counsel appearing on behalf of the petitioners and Mr. Suman Kumari, learned APP for the State.
2. The petitioners seek pre-arrest bail in connection with Harnaut P.S. Case No. 549 of 2023 registered for the offence punishable under Sections 147, 341, 353, 337, 427, 504 and 506 of the Indian Penal Code.
3. As per the allegation made in the F.I.R., the
Patna High Court CR. MISC. No.1495 of 2024(2) dt.31-01-2024 2/3 petitioners who are named therein along with other accused persons tried to misbehave with the informant and obstructed the police force in discharging government work.
4. Learned counsel appearing on behalf of the petitioners submitted that due to village politics and enmity, the petitioners have been falsely implicated in the case. The petitioners happen to be member of the mob and no specific allegation has been alleged against them. On these ground, the petitioners seek to be released on pre-arrest bail.
5. Learned APP for the State has vehemently opposed the prayer for grant of pre-arrest bail to the petitioners.
6. Considering the nature of allegation made in the F.I.R. and the fact that altogether 100 people had assembled and had obstructed the police force in discharging government work, the petitioners happen to be member of the mob and the F.I.R. has been lodged after a delay of 37 days by the Block Development Officer, the petitioners, above named, are directed to be released on pre-arrest bail, in the event of their arrest or surrender before the Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda at
Patna High Court CR. MISC. No.1495 of 2024(2) dt.31-01-2024 3/3 Biharsharif in connection with Harnaut P.S. Case No. 549 of 2023, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
