2. The petitioner is in custody in a case registered for the offence punishable under Sections 20(b)(ii)(B) of the NDPS Act.

3. As per allegation in the FIR, it is a case of recovery of 2.60 ganja recovered from the possession of the petitioner.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. He next submits that petitioner has no concern with the seized ganja and he is in custody since 14.06.2024 and he has got no criminal antecedent.

5. Learned APP for the State opposes the prayer for

Patna High Court CR. MISC. No.88085 of 2024(2) dt.08-01-2025 2/2 bail of the petitioner.

6. On perusal of the first information report and impugned order dated 16.11.2024, it appears that total 2.60 k.g. ganja was recovered from the possession of the petitioner which is less than commercial quantity and he has got clean antecedent, so considering all aspects of the matter, I am inclined to grant bail to the petitioner.

7. Accordingly, let the above named petitioner be released on bail on furnishing bail bond of the Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge, NDPS, Bettiah, West Champaran in connection with Bettiah (Muffasil) P.S. Case N o. 334 of 2024.
