2. Earlier bail petition of the petitioner was rejected by this Court vide order dated 15.05.2023 in Cr. Misc. No.6249 of 2023 but the fresh ground for renewing the prayer for bail is that the petitioner along with two other co-accused persons filed a petition under Section 227 of the CrPC before the court below mentioning that Section 26(i) of the Arms Act is not attracted. As Such, the case was not found to be triable by court of sessions against the petitioner. The court below passed the order on the petition under Section 227 of the CrPC and found that no case under Section 26(i) of the Arms Act is attracted

3. The learned counsel for the petitioner submitted that considering the aforesaid facts, two co-accused persons namely, Bajrang Kumar Sarraf and Aditya Kumar @ Aditya Kumar Sarraf were granted bail by this Court vide order dated 03.11.2023 in Cr. Misc. No. 72800 of 2023 and the case of the petitioner is exactly on similar footing.

4. Considering the above-mentioned facts and circumstances, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, VIII, Patna in Connection With Jakkanpur P.S.
