2. The petitioner seeks regular bail in connection with Sessions Trial No. 930 of 2025 arising out of Gardanibagh P.S. Case No. 785 of 2024 lodged on 05.06.2024, for the offence punishable under Sections 406, 420, 120-B, 302 & 34 of the Indian Penal Code and section 27 of the Arms Act.

3. Learned counsel for the petitioner submits that the regular bail application of the petitioner was earlier rejected vide order dated 06.08.2025 passed in Cr. Misc. No. 37042 of 2025 with liberty granted to the petitioner to renew his prayer for bail three months after framing of charge. Counsel submits that charge has already been framed on 02.08.2025, but since, this information was not disclosed by the pairvikar to the then

Patna High Court CR. MISC. No.147 of 2026(3) dt.25-02-2026 2/3 petitioner, therefore, this fact could not be placed in the earlier rejection order. Counsel submits that more than three months after framing of charge have been lapsed. Counsel further submits that the criminal antecedent of the petitioner is not clean as there is one case pending against him in which he is on bail. The petitioner is in custody since 20.06.2024. Counsel also submits that on earlier occasion, report with regard to the present stage of the trial was called for.

Learned APP for the State opposes the prayer for bail of the petitioner and submits that on earlier occasion, report with regard to the present stage of the trial was called for and from the said report, it transpires that the co-accused having same allegation was granted bail by the Co-ordinate Bench of this Court vide order dated 13.05.2025 passed in Cr. Misc. No. 7941 of 2025. It also transpires that the charge has been framed and summons to the witnesses have been issued.

In the present facts and circumstances of this case, let the above named petitioner be granted bail, on furnishing bail bond of Rs.30,000/- (Rupees Thirty Thousand) as mentioned in Section 2(1)(d) of the B.N.S.S., 2023 to the satisfaction of A.D.J.-II, Patna in connection with Sessions Trial No. 930 of 2025 arising out of Gardanibagh P.S. Case No. 785

Patna High Court CR. MISC. No.147 of 2026(3) dt.25-02-2026 3/3 of 2024, subject to the conditions as laid down U/s 480(3) of the B.N.S.S., 2023, with the following further conditions:- (i) one of the bailor should be the family member of the petitioner who shall provide official document to show his bona fide;

(ii) the petitioner shall appear before the Trial Court on each and every scheduled date, and failure to do so for three consecutive dates without any plausible reason/explanation shall be resulted into cancellation of his bail bonds by the Trial Court itself;

(iii) the petitioner shall appear before the concerned police station for two years, within every fortnight, to mark his attendance.
