JUSTICE RAKESH KUMAR ORAL ORDER 30-11-2018 Two petitioners, having clean antecedent, which fact has been stated in paragraph-3 of the petition, have prayed for grant of bail in Runnisaidpur P.S. Case No. 515 of 2018 registered for offence under Sections 30, 30(g), 38(i) (ii) of the Bihar Prohibition and Excise Act, 2016.
On examination of the F.I.R., it appears that inside the boundary of the house of the petitioner no. 1, it was alleged that there was recovery of Indian Make Foreign Liquor, but in the seizure list, which has been enclosed with the F.I.R., in column no. 3, which is meant for the place of seizure, only it has been mentioned as village- Lalpur P.S. - Runnisaidpur, DistrictSitamarhi. Both petitioners are in custody since 9.9.2018 as
Patna High Court Cr.Misc. No.69449 of 2018(2) dt.30-11-2018 2/2 stated in paragraph-12 of the petition.
Learned Addl. Public Prosecutor has opposed the prayer for grant of bail.
Be that as it may, considering the nature of accusation as well as clean antecedent, which fact has been stated in paragraph- 3 of the petition, let both the petitioners, namely, (i) Sakhichan Das @ Sakhichandra Das and (ii) Ranjit Das be enlarged on bail on furnishing bail-bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.D.J. -II-cum-Special Judge, Excise Act, Sitamarhi in connection with Runnisaidpur P.S. Case No. 515 of 2018.
