The petitioner seeks bail in connection with Kuchaikot P.S. Case No. 344 of 2019 registered for the offences punishable under Sections 30(a), 32(2), 41(1) of the Bihar Provision and Excise (Amendment) Act, 2018.

Learned counsel for the petitioner submits that there is recovery of 3407 liters of Indian made foreign liquor from the truck. Learned counsel for the petitioner further submits that the petitioner is the driver of the said truck. Learned counsel for the petitioner further submits that there is no recovery from the conscious possession of the petitioner. He further submits that the petitioner has got no criminal antecedent. Petitioner is in jail custody since 18.10.2019.

No.78098 of 2019(2) dt.04-12-2019 2/2 In the facts and circumstances of the case, I am inclined to grant bail to the petitioner, subject to deposit of Rs.50,000/- in the court below/Nazarat. Let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of 2nd Additional Sessions Judge cum Special Judge, Excise, Gopalganj in connection with Kuchaikote P.S. Case No. 344 of 2019.

Such deposit of Rs.50,000/- shall abide by the outcome of the criminal case.
