Petitioner seeks bail in a case registered for the offences punishable under Section 414 of the Indian Penal Code and 30(a) of Excise Act, 2018.

21.6 liters of country made liquor was recovered from the bag hanging with the petitioner. Petitioner has got identical criminal antecedent.

Considering the joint effect of nature of recovery of huge quantity of liquor as well as criminal antecedent of the petitioner, in my view, the petitioner should be released on bail after framing of the charges to avoid delay in trial on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of

No.80662 of 2019(2) dt.09-12-2019 2/2 learned Court below where the case is pending in connection with Adhaura Police Station Case No.51 of 2019, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioner shall fully cooperate with the investigation of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
