JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER (Per: HONOURABLE THE CHIEF JUSTICE) 08-01-2020 The petition filed on 04.01.2020 is listed for hearing for the first time today before the Court.

Heard learned counsel for the petitioner and learned counsel for the respondents.

Petitioner has prayed for the following relief/s: " (i) To direct the respondents to include the name of only one member of the Family in the volter list of Samai PACS in the year, 2019 as from one family the name of 4-5 PACS members or more of the family have been included in the Voter list of Samai PACS published in the year, 2019 for serial no. 1322 to 1621 which is against the mandate of law.

Patna High Court CWJC No.74 of 2020(2) dt.08-01-2020 2/2 (ii) Also to direct the respondent to remove the name of other members of the family (except one member of the family), whose name have been included in the voter list of Samai PACS published in the year, 2019 with oblique motive and malafide intention and the name of 4/5 member or more members of one family has been included in the voter list of Samai PACS under Nawada Sadar Block in the district of Nawada.

(iii) Also to direct the respondent to declare the member of Samai PACS of such farmers who applied On Line for membership of Samai PACS and further published in the year, 2019.

(iv) Also to direct the respondents to revise the voter list of Samai PACS Published in the year, 2019 by excluding the name of illegal voters and also to include the name of other farmers who submitted their application On Line for membership of Samai PACS.

(v) Also for any other relief/reliefs for which the petitioner is found to be entitled in the eye of law." Learned counsel for the petitioner seeks permission to withdraw the present petition.

Prayer allowed.
