2. The petitioner is apprehending his arrest in a case in connection with Lachhaur P.S. Case No. 15 of 2023 dated 11.02.2023 registered for the offence/s punishable u/ss 147, 148, 149, 341, 323, 324, 325, 307, 504 and 506 and 354 of the Indian Penal Code and section 27 of the Arms Act.
3. As per the prosecution case, the petitioner and the co-accused persons are alleged to have abused and assaulted the informant and her family members. The accused Vicky Kumar fired on Maheshwar Yadav causing
Patna High Court CR. MISC. No.2870 of 2024(3) dt.20-02-2024 2/3 injury on his left thigh. The co-accused Nitish Kiumar also fired on the husband of the informant due to that he sustained bullet injury on his right hand. The co-accused person Murari Yadav also assaulted Brajesh Yadav with Tangi and they also assaulted the informant with Lathi.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case due to land dispute. It is further submitted that the injury is stated to be simple in nature. The specific allegation of firing is against the co-accused person who has already been granted bail by this court vide order dated 02.01.2024 passed in Cr. Misc. No. 76951 of 2023. The petitioner is also accused in one more criminal case as stated in para 3 of the bail petition.
5. Learned A.P.P. for the State has vehemently opposed the anticipatory bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances of the case, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bailbond of Rs. 20,000/- (Rupees twenty thousand) with two
Patna High Court CR. MISC. No.2870 of 2024(3) dt.20-02-2024 3/3 sureties of the like amount each to the satisfaction of the learned court concerned, Jamui in connection with Lachhaur P.S. Case No. 15 of 2023, subject to conditions as laid down under section 438(2) of the Code of Criminal Procedure.
