JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 15-01-2024 Heard learned counsel for the petitioner and learned A.P.P appearing on behalf of the State. The petitioner is languishing in custody in a case registered for the offences punishable under Sections 304(B)/34 of the Indian Penal Code.

The accusation is of killing the daughter of the informant for non-fulfillment of dowry demand. It is submitted by learned counsel for the petitioner that petitioner is innocent and she has falsely been implicated in this case. The petitioner is mother-inlaw of the deceased and she had no concern with the day-do-day affairs of the deceased and her husband. The

Patna High Court CR. MISC. No.215 of 2024(2) dt.15-01-2024 2/2 petitioner lives separately from the husband of the deceased. The petitioner is languishing in custody since 10.07.2022.

In contra, learned A.P.P appearing on behalf of the State has vehemently opposed the prayer for bail of the petitioner.

Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge, 1st, Gopalganj in connection with Vijaipur P.S. Case No. 147 of 2022 (Sessions Trial No. 534/2022).
