The petitioner seeks bail in a case registered for the offence punishable under Sections 341, 323, 307, 325 and 504 of the Indian Penal Code.

Learned counsel for the petitioner submits that the prosecution case in short is that on 21.08.2019 this petitioner assaulted to informant on his head by iron rod repeatedly with intention to kill him due to which the informant sustained serious injuries. The prosecution case as well as legal evidence available on record it appears that not a single witness has supported the prosecution case of the informant against the petitioner save and except the land dispute, as per the impugned order appears that the injury is found simple in nature. Patna High Court CR. MISC. No.78029 of 2019(2) dt.04-12-2019 2/2 is in custody since 24.08.2019 and has no criminal antecedent. Learned counsel for the petitioner submits that it appears that now matter is compromise between the parties for which is a joint compromise petition is filed on 18.09.2019 before the learned Court of Sri D. Singh, J.M. Ist Class at Katihar.

In the facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned J.M.1st Class, Katihar in connection with Amdabad P.S. Case No. 183 of 2019.
