This application for regular bail arises out of Didarganj P.S. Case No. 288 of 2019, disclosing offences punishable under Sections 448, 341, 323, 354 B, 504 and 34 of the Indian Penal Code and under Sections 8 and 12 of the POCSO Act.

Learned counsel appearing on behalf of the petitioner is correct in his submission that no offence under the provisions of 354 B of the Indian Penal Code and Section 8 and 12 of the POCSO Act, is made out against the petitioner, on the basis of what has been alleged in the F.I.R. The allegation of such criminal misconduct is against the co-accused Sunny Kumar. On perusal of the First Information Report, I find

Patna High Court CR. MISC. No.77938 of 2019(3) dt.06-03-2020 2/2 substance in the said submissions. This application is allowed. Let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Court of Additional District and Sessions Judge, 1st cum Special Judge, POCSO, Patna in connection with Didarganj P.S. Case No. 288 of 2019.
