JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 11-12-2019 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Goh P.S. Case No. 239 of 2018, G.R. No. 1058 of 2018 for the offenses under Section 420 IPC and Section 30(a) of the Bihar Prohibition and Excise Act, 2018.

Learned counsel for the petitioner submits that in the instant case 600 spirit was recovered from a Safari vehicle bearing registration No. JH01GT 8632. The petitioner is owner of the vehicle and he was not aware of the fact that spirit was loaded in the vehicle. The petitioner is in custody since 4.10.2019.

In view of the above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 50,000/-

Patna High Court CR. MISC. No.81517 of 2019(2) dt.11-12-2019 2/2 (Fifty Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-VII-cumSpecial Judge (Excise Act), Aurangabad in connection with Goh P.S. Case No. 239 of 2018, G.R. No. 1058 of 2018, subject to deposit of Rs. 50,000/- cash.

The deposit of cash of Rs. 50,000/- shall abide by the final outcome of the pending criminal case.
