2. The present petition has been preferred for the following relief/s:

(i) for issuance of mandamus or any other writ/order/orders/direction/directions directing the respondents to for bear from construction of the canals through the

Patna High Court CWJC No.22645 of 2018(2) dt.10-11-2025 2/3 petitioner's land as the petitioner is husband of the landlady Nita Devi @ Nita Singh whose land has forcibly been occupied by the respondent no. 5 without approval and consent from the landlady who has been suffering from cancer at Soniya Gandhi post Graduate Institute of Medical Sciences, Lucknow.

3. The counter affidavit of the Circle Officer, Khagaria is on record after service of copy in the year 2020 itself, according to which it has been recorded that the petitioner has alternative remedy and without availing the same, he has invoked writ jurisdiction of this Court.

4. Learned counsel for the petitioner submits that he may be allowed to approach the appropriate authority for the redressal of the grievance.

5. The State has no objection.

6. In that background, the writ petition is disposed of allowing the petitioner to approach the appropraite authority and in case, the same is filed in next four weeks, the concerned authority shall look in the matter and dilute the delay in filing the same as the matter was pending before this Court since the

Patna High Court CWJC No.22645 of 2018(2) dt.10-11-2025 3/3 year 2018.

7. With the aforesaid observation, the writ petition is disposed of.
