JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-12-2019 Petitioner seeks regular bail in connection with Haspura P. S. Case No. 29 of 2019, registered for the offence punishable under Section 30(a) of the Bihar Prohibition & Excise Act, 2018.

As per F.I.R. recovery of 44 liters of liquor from the Goshala of the petitioner. It further appears that he is accused in one more case also.

Submission of the learned counsel for the petitioner is that Goshala is open place and in other case he is on bail. Petitioner is in custody for two months. Charge sheet has already been submitted, and as such, there is no chance of tampering with the evidence.

Having heard both sides, in view of the facts and

No.81006 of 2019(2) dt.10-12-2019 2/2 circumstances, as stated above, let the petitioner above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Additional Sessions JudgeVII-cum-Special Judge, Excise, Aurangabad, in connection with Haspura P. S. Case No. 29 of 2019, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned with condition, if he found involve in such type of cases in future, the prosecution is at liberty to move for cancellation of his bail bonds.
