The petitioner seeks bail in Roshanganj P.S. Case No.23 of 2017, registered under Section 392 of the Indian Penal Code and 17 of the C.L.A. Act.

The petitioner and two others are alleged to have looted away D.J. Track FT machine and mobiles from the employees due to non-payment of levy and fled away towards Sherghati.

Learned counsel for the petitioner submits that nothing has been recovered from possession of the petitioner. The petitioner was remanded in this case on 23.03.2019 and since then he is in custody but it appears that the petitioner is a dreaded naxalite and as many as 16 criminal cases have been

Taking into consideration the facts aforesaid, I am not inclined to enlarge the petitioner on bail. Accordingly, the prayer for bail of the petitioner is rejected.

The trial court is directed to hold the trial on day to day basis and conclude the same within six months from the date of receipt of this order.

If the trial is not concluded within six months, the petitioner may renew his prayer for bail.
