2. The petitioner seeks bail in a case registered for the offence punishable under sections 309(4) of the Bharatiya Nyaya Sanhita.
3. As per the prosecution case, the bike of the informant is alleged to have been snatched away by two unknown miscreants. During the course of the investigation, the petitioner is said to have been apprehended who confessed his guilt in the present incident and has also named one Ajit Kumar @Ajeet Kumar @Ajit Paswan and others.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the
Patna High Court CR. MISC. No.2307 of 2025(6) dt.07-07-2025 2/3 present case. It has further been submitted that from perusal of the seizure list at Page 20, it appears that one TVS company red colored bike was recovered from the petitioner, which admittedly is not the bike that was said to have been snatched away. The learned counsel has next submitted that till date no TIP has been conducted and the petitioner has one criminal antecedent and has been in custody since 25.07.2024. It has lastly been submitted that one of the co-accused from whom recovery was made, namely Ajit Kumar @ Ajeet Kumar @ Ajit Paswan, has been granted bail by a coordinate bench of this court vide order dated 27.02.2025 passed in Cr. Misc. No. 80323 of 2024.
5. Learned APP appearing for the state has opposed the prayer of regular bail.

Considering the aforesaid facts and circumstances of the case, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending /concerned court, in connection with Pusa P.S. Case No. 75 of 2024 subject to the conditions that (i) One of the bailors will be a

(ii) The petitioner will remain present on each and every date fixed by the Court below, if so required by the learned Trial Court.
(iii) In case of absence on two consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be canceled by the Court concerned. (iv) And further condition that the court below shall verify the criminal antecedent of the petitioner and in case at any stage it is found that the petitioner has concealed his criminal antecedent, the court below shall take step for cancellation of bail bond of the petitioner. However, the acceptance of bail bonds in terms of the above-mentioned order shall not be delayed for purpose of the same or in the name of verification.
7. It is made clear that the observations, if any, made in this order, shall be of no bearing during the trial. (Sourendra Pandey, J) Prakash/- U
