JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-12-2018 Petitioner prays for bail in connection with Riga P.S.Case No. 319 of 2015 registered for the offences punishable under Sections 307, 120B, 34 of the Indian Penal Code and Section 27 of the Arms Act.
Allegation as per FIR is that informant while returning from his house on motorcycle, two persons, including the petitioner started firing their pistol, due to which he sustained three firearm injuries.
Submission of learned counsel for the petitioner is that no specific allegation has been attributed against him and co-accused persons have been granted bail vide order dated 29.9.2016 in Cr.Misc.No. 34181 of 2016 and vide order dated 29.3.2017 in Cr.Misc.No. 9791 of 2017 and petitioner is in custody since 23.7.2018.

Having heard both sides and in the facts and circumstances, as stated above, and also considering the fact that other co-accused persons have been granted bail by coordinate Bench of this Court, let petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-III, Sitamarhi, in connection with Riga P.S.Case No. 319 of 2015, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
