The petitioner seeks bail in a case registered under Section 392 of the Indian Penal Code.

Allegation is that the accused persons and three unknown miscreants on the points of pistol snatched two ATM cards of Axis Bank and Canara Bank from the informant and asked him to disclose PIN code and due to fear he disclosed PIN numbers and they withdrawn Rs.46000/- from Axis Bank and Rs.7000/- from Canara Bank and they also snatched Rs.10000/- cash from his possession.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 8.8.2019. Charge sheet has

Patna High Court CR. MISC. No.83230 of 2019(2) dt.16-12-2019 2/2 been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is not named in the F.I.R. His name has come on confessional statement of co-accused. There is no recovery of any incriminating article from the possession of the petitioner. The petitioner has not been put on T.I.P.

On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. II, Danapur, Patna in connection with Rupaspur P.S. case No.315 of 2019.
