2. The petitioner seeks bail in a case registered for offence under Sections 103, 3(5) of the B.N.S., 2023 and Section 27(3) of the Arms Act.
3. As per F.I.R., the informant, who claims to be eyewitness to the occurrence, alleges that F.I.R. named accused persons made indiscriminate firing upon his elder brother, on account of which, elder brother of informant sustained gut-shot injury on his chest and abdomen. Thereafter, injured (brother of informant) was brought to Sadar Hospital, Gopalganj on Scorpio for treatment where the doctor declared him dead.
4. Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. and his name surfaced during investigation. He further submits that it is the specific case of the informant, who claims to be eye-witness to the
Patna High Court CR. MISC. No.85050 of 2025(2) dt.11-12-2025 2/3 occurrence, that F.I.R. named accused persons committed murder of elder brother of informant. The informant did not raise any suspicion or whisper about this petitioner. Three F.I.R. named accused persons have already been granted regular bail by a coordinate Bench of this Court, vide order dated 23.06.2025 passed in Cr.Misc. No. 27665 of 2025 with Cr.Misc. No. 36933 of 2025 (Annexure P/3) and petitioner is in custody since 03.03.2025. Chargesheet has been submitted.

Learned counsel for the informant vehemently opposes the prayer for bail and submits that though, petitioner is not named, but his involvement in the occurrence has surfaced during course of investigation. He further submits that vide aforesaid order (Annexure P/3), F.I.R. named accused persons were granted bail by the coordinate Bench of this Court, considering the fact that during investigation, sufficient materials were collected against this petitioner and other coaccused and as such, this petitioner does not deserve privilege of bail.
6. Considering the nature of accusation, period of custody and the fact that petitioner is not named in the F.I.R. and informant, who claims to be eye-witness to the occurrence, has specifically mentioned in his Fardbeyan that F.I.R. named
Patna High Court CR. MISC. No.85050 of 2025(2) dt.11-12-2025 3/3 accused persons committed the murder of his brother, the prayer for bail of petitioner is allowed.
7. Let the petitioner, named above, be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge - III, Gopalganj in connection with Sessions Trial No. 208 of 2025, arising out of Uchkagaon P.S. Case No. 12 of 2025.
