The petitioner apprehends his arrest in a case registered for the offence punishable u/s 406, 420, 504, 506 of the IPC. 3.
As per the prosecution case, the allegation against the petitioner is that he along with other co-accused persons received Rs.91,754/- from the informant in five installment for filing the ITR but the same was not done.

It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. He has been falsely implicated in this case due to ulterior motive. It is submitted that the petitioner has not received any single paise. All the amount was deposited in the account of the co-accused Abhishek Sah. It is further submitted that the petitioner is ready
Patna High Court CR. MISC. No.4208 of 2024(3) dt.21-03-2024 2/2 to deposit the said amount of Rs.91,754/- in the Nazarat which may be directed to be released in favour of the informant, subject to the final outcome of the present case. Petitioner has no criminal antecedent.

Learned APP for the State opposed the prayer for bail. 6.
Having regard to the facts and circumstances of the case, since the petitioner is ready to return the aforesaid amount, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/Successor Court in connection with Baunsi P.S. Case No.80 of 2023, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. 7.
The bail bond of the petitioner shall be accepted by the learned Court below after showing the receipt of the deposit of the above said amount in the Nazarat, Banka and the said amount shall be released in favour of the informant, subject to the final outcome of the case.
