Heard learned counsel for the petitioners and learned A.P.P. for the State.

The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 109, 303(2), 352, 351(2), 3(5) of the BNS and Section 27 of Arms Act.

Learned counsel for the petitioners submits that the petitioners are persons with clean antecedent and have been falsely implicated in the instant case by the informant. It is next

No.88069 of 2024(2) dt.08-01-2025 2/3 submitted that from perusal of the allegation as alleged in the FIR, it would manifest that the informant alleges that the accused persons came and started abusing and also assaulted his son by brick on his thigh, but then the villagers interferred, when the quarrel was settled, but again on the same day at 10 a.m., the accused persons came, and Vicky and Amrit asked the informant and his family members to come out, but they closed themselves inside the house when the accused persons started indiscriminate firing and one bullet after hitting the wall rebounded and hit Amrit causing injury on his head and hand. 4.

The learned counsel for the petitioners submits that it was the informant and his side who fired causing injury to Amrit for which the Didarganj PS Case No. 363 of 2024 dated 15-10-2024 has been instituted. It is next submitted that the instant case has been instituted by way of counter-blast. It is also submitted that from perusal of the allegation as alleged in the FIR, it would manifest that no one was injured from the side of the informant.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.

Considering the submissions made by the learned counsel for the petitioners and the fact that petitioners are

No.88069 of 2024(2) dt.08-01-2025 3/3 persons with clean antecedent, the petitioners above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Didarganj P.S. Case No. 364 of 2024, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. (Satyavrat Verma, J) SUMIT/- U T
